Terms and conditions

These terms govern the contracting and use of the Almenara platform (the "service"), provided by José Ramón Santos Crespo. By accepting a proposal or creating an account, you accept these terms.

2. Accounts

Using the service as a customer requires creating an account with accurate information and keeping it up to date. You are responsible for the confidentiality of your credentials and for all activity under your account. Registering as a supplier to answer questionnaires is free.

3. Engagement and billing

The modules, services, amounts and billing terms for each customer are set out in the proposal they accept. Amounts exclude tax, which is added as applicable.

4. Acceptable use

By using the service you agree not to: (a) use it for unlawful or fraudulent purposes; (b) attempt unauthorised access to other customers' systems or data; (c) interfere with the service's operation or attempt to bypass its security measures; (d) resell or sublicense access to the service without express authorisation.

5. Service level (SLA)

Full details of compensation and the claims procedure are set out in the service level agreement applicable to each contract.

6. Intellectual property

The service, its code, design and trademarks are owned by José Ramón Santos Crespo. Use of the service does not transfer any intellectual property rights to the customer. Data the customer enters into the platform (questionnaires, answers, evidence) remains owned by the customer or their suppliers, as applicable.

7. Limitation of liability

To the extent permitted by law, José Ramón Santos Crespo's liability to the customer for damages arising from use of the service is limited to the amount actually paid by the customer in the 12 months preceding the event giving rise to the claim. José Ramón Santos Crespo is not liable for indirect damages, loss of profit or data loss arising from misuse of the service by the customer.

8. Term and termination

The contract lasts for the term set out in the accepted proposal and renews automatically unless cancelled with the notice stated in it; cancellation takes effect at the end of the current period. José Ramón Santos Crespo may suspend or terminate access in the event of a serious breach of these terms, with prior notice unless urgency prevents it.

9. Changes

These terms may be updated to reflect changes to the service or applicable law. Material changes will be communicated to active customers with reasonable notice.

10. Governing law

These terms are governed by Spanish law, with submission to the courts indicated in the legal notice.
